Overview of the Program

The EB (Employment-Based) Program (Unskilled Workers Category) enables unskilled workers (occupations requiring less than two years’ training or experience) to enter the U.S. as Green Card holders with full-time, permanent employment. An applicant must meet minimum qualification requirements and can include his/her spouse and unmarried children below the age of 21 in the application

Requirements

  • Applicant must be physically fit (in good health conditions to perform the work).
  • No educational requirements.
  • Commitment to work with the employer for a minimum of one year and a half.
  • The applicant must have a job offer made by an employer in the United States at the time of application.
  • The applicant must complete a labor certification procedure approved by the US Department of Labor.
  • Employers inviting foreigners to work must obtain approval from the US Department of Labor showing that the employment of that particular foreign citizen will not adversely affect the US labor market and that the employer has the necessary financial means to pay the salary of the foreign worker.

Process and Terms

  • Background/Eligibility check.
  • Employer completes steps for Permanent Labor Certification (PERM) through the US Department of Labor. During this process, the employer will interview you via internet video to explain the job and determine your placement.
  • PERM approval: 6-10 monthsis typical, longer if DOL (Department of Labor) audits the case.
  • Once PERM is approved, the employer submits the following on your behalf to USCIS:
    o I-140 application
    o Approved Labor Certificate
    o All supporting documents.
  • I-140 approval will take 15 days (if additional 2500$ is paid for premium processing) or 6 months – 10 years (without premium processing) if the priority in your home country is current, could be longer if case is audited.
  • After the USCIS approves your initial I-140 application, your immediate family (spouse and any children under the age of 21) can also apply for immigrant visas.
  • Complete Form DS-260, an online Immigrant Visa Application & Registration form. Waiting time for letter from National Visa Center: 30-60 days.
  • National Visa Center (DS-260) processing: 30-60 days if applicant provides in timely fashion.
  • Attend your one-on-one consular interview when you are called.

FAQs

The EB program does not require any work experience or net worth value. Through this program, you will arrive in the US with a permanent, full-time job and permanent residency for you and your family. You will also be able to include your spouse and unmarried children below the age of 21 in your application. They will then be able to work and study in the US as Green Card holders. It also takes around 1.5 to 2 years to process, which is a shorter period compared to most immigration programs.
All employers must submit a prevailing wage determination which ensures that they are paying at least the minimum wage set in their state. Salaries vary depending on the job and the area but they usually average around USD 10.00 – USD 15.00 per hour.
The Green Card can only be ordered upon arrival in the U.S. In the meantime, the visa is endorsed and serves as a Permanent Residency document until the actual card arrives. This can be used for employment, opening bank accounts, etc.

As a Green Card holder, you will be able to apply for U.S. Citizenship and get the passport. Below are the requirements you must fulfill:

  • Be at least 18 years old at the time of filing Form N-400, Application for Naturalization.
  • Be a permanent resident (have a “Green Card”) for at least 5 years.
  • Show that you have lived for at least 3 months in the state or USCIS district where you apply.
  • Demonstrate continuous residence in the United States for at least 5 years immediately preceding the date of filing Form N-400.
  • Show that you have been physically present in the United States for at least 30 months out of the 5 years immediately preceding the date of filing Form N-400.
  • Be able to read, write, and speak basic English.
  • Have a basic understanding of U.S. history and government (civics).
  • Be a person of good moral character.
  • Demonstrate an attachment to the principles and ideals of the U.S. Constitution.
Under this program, a joint application is filed between the employer and employee with the Department of Labor. In the event the employee fails to fulfill the job duties (i.e. suddenly leave the job) there is a possibility that the employer can file a complaint with the Department of Labor which may result in the termination of his/her Green Card. It is recommended that you stay with the employer for at least one year to avoid any issues such as this.

Employment-based Green Card requires a PERM Labor Certification from the U.S. DOL.

Prospective U.S.-based employers are not allowed to hire foreign workers directly. First, they need to establish that are no available workers already living in the U.S. who can fill the position.

To be approved, the PERM certification must also pass a Prevailing Wage Determination. Thus, your sponsor needs to prove that the job vacancy has also been advertised in major local newspapers and relevant agencies.

The DOL may also ask to access to a detailed record of the recruitment process that has been conducted to fill the position.
